1. Postanowienia ogólne

Niniejszy regulamin określa zasady korzystania z aplikacji i serwisu GustoNote (dalej „Usługa"). Usługodawcą jest Robert Rosot, ul. Gen. St. Maczka 1/27, 34-400 Nowy Targ, NIP 7351702205 (dalej „Usługodawca"). Kontakt: info@gustonote.com.

2. Definicje

• Usługa - aplikacje GustoNote (dziennik degustacji) oraz strona internetowa.
• Użytkownik - osoba korzystająca z Usługi.
• Konto - indywidualny profil Użytkownika.
• Plan Free - bezpłatny zakres Usługi.
• Plan Pro - płatny, rozszerzony zakres Usługi (wykupywany dla danego modułu).
• Moduł - kategoria degustacji (np. wino, whisky, piwo, kawa, herbata).

3. Rodzaj i zakres Usługi

GustoNote to dziennik degustacji umożliwiający zapisywanie notatek, ocen i profili sensorycznych, kalibrację opisu względem wzorca oraz analizę własnych wpisów. Usługa działa również offline (jako aplikacja PWA), a dane są synchronizowane z kontem Użytkownika.

4. Wymagania techniczne

Do korzystania z Usługi potrzebne są: urządzenie z aktualną przeglądarką internetową, dostęp do Internetu (do logowania i synchronizacji) oraz aktywny adres e-mail (lub konto Google) do założenia Konta.

5. Konto i rejestracja

• Konto zakłada się przez rejestrację adresem e-mail i hasłem albo przez logowanie Google.
• Rejestracja adresem e-mail wymaga potwierdzenia adresu poprzez link wysłany na podany e-mail.
• Użytkownik zobowiązany jest podać prawdziwe dane i chronić dane logowania.
• Aplikacja dotycząca alkoholu (wino, whisky, piwo) przeznaczona jest wyłącznie dla osób pełnoletnich (18+). Zakładając konto i korzystając z tej aplikacji, Użytkownik oświadcza, że ukończył 18 lat.

6. Plan Free i Plan Pro, płatności

• Plan Free jest bezpłatny i obejmuje korzystanie z podstawowych funkcji w ustalonym zakresie (m.in. ograniczona liczba wpisów na moduł).
• Plan Pro znosi limity oraz udostępnia funkcje dodatkowe w wykupionym module. Pro wykupywany jest osobno dla danego modułu.
• Aktualne ceny i okres ważności planu Pro podane są na stronie oraz w aplikacji w chwili zakupu.
• Płatności obsługuje zewnętrzny operator Przelewy24 (PayPro S.A.). Usługodawca nie przechowuje danych kart płatniczych.
• Plan Pro ma charakter czasowy (np. abonament roczny) i - o ile nie wskazano inaczej w chwili zakupu - nie odnawia się automatycznie; po wygaśnięciu moduł wraca do Planu Free (dane Użytkownika nie są usuwane).

7. Polecane (treści promocyjne)

Usługa może wyświetlać własne oraz partnerskie treści promocyjne („Polecane") - zarówno w Planie Free, jak i Pro. Pełnoekranowe Polecane mogą pojawiać się wyłącznie w Planie Free. Użytkownik może wyłączyć wyświetlanie Polecanych w ustawieniach aplikacji.

8. Prawo odstąpienia od umowy (konsument)

Konsument oraz przedsiębiorca na prawach konsumenta może odstąpić od umowy w terminie 14 dni bez podania przyczyny. Plan Pro stanowi dostarczanie treści cyfrowych/usługi cyfrowej. Jeżeli Użytkownik zażąda rozpoczęcia świadczenia (udostępnienia funkcji Pro) przed upływem terminu na odstąpienie i wyrazi na to wyraźną zgodę oraz przyjmie do wiadomości utratę prawa odstąpienia po pełnym wykonaniu - prawo odstąpienia wygasa z chwilą pełnego wykonania usługi. W zakresie świadczenia spełnionego do dnia odstąpienia konsument może być zobowiązany do zapłaty proporcjonalnej części wynagrodzenia.

9. Reklamacje

Reklamacje można zgłaszać na adres info@gustonote.com. Reklamację rozpatrzymy w terminie do 14 dni i poinformujemy o wyniku na adres e-mail Użytkownika.

10. Dane i treści Użytkownika

Wpisy, notatki i inne treści wprowadzone przez Użytkownika pozostają jego własnością. Użytkownik może w każdej chwili wyeksportować swoje dane (kopia w formacie JSON) oraz usunąć konto. Zasady przetwarzania danych osobowych opisuje Polityka prywatności.

11. Odpowiedzialność

Usługa udostępniana jest „taka, jaka jest". Dokładamy starań, by działała poprawnie i była dostępna, lecz nie gwarantujemy nieprzerwanego, bezbłędnego działania. GustoNote jest narzędziem do prywatnych notatek - oceny i kalibracja mają charakter pomocniczy/edukacyjny. Odpowiedzialność Usługodawcy ogranicza się do zakresu dozwolonego przepisami prawa; nie wyłączamy ani nie ograniczamy odpowiedzialności w zakresie, w jakim jest to niedopuszczalne wobec konsumentów. Nazwy i znaki podmiotów trzecich (m.in. SCA - Specialty Coffee Association) należą do ich właścicieli i używane są wyłącznie opisowo; GustoNote nie jest z nimi powiązane ani przez nie certyfikowane.

12. Niedozwolone działania

Zakazane jest korzystanie z Usługi w sposób niezgodny z prawem, naruszający prawa osób trzecich, zakłócający działanie Usługi lub próbujący uzyskać nieuprawniony dostęp do danych innych Użytkowników.

13. Zmiany Regulaminu

Usługodawca może zmienić Regulamin z ważnych przyczyn (np. zmiany prawne, techniczne, zmiana zakresu Usługi). O zmianach poinformujemy w aplikacji lub na stronie. Dalsze korzystanie z Usługi po wejściu zmian w życie oznacza ich akceptację; w przypadku braku akceptacji Użytkownik może usunąć konto.

14. Rozwiązanie umowy

Użytkownik może w każdej chwili zrezygnować z Usługi, usuwając konto. Usługodawca może rozwiązać umowę lub zablokować konto w razie rażącego naruszenia Regulaminu lub przepisów prawa.

15. Prawo właściwe i spory

W sprawach nieuregulowanych stosuje się prawo polskie oraz właściwe przepisy Unii Europejskiej. Niniejsze postanowienie nie pozbawia konsumenta ochrony wynikającej z bezwzględnie obowiązujących przepisów państwa jego zamieszkania. Konsument może skorzystać z pozasądowych sposobów rozpatrywania sporów, w tym z platformy ODR Komisji Europejskiej.

Terms of Service

1. General

These terms set out the rules for using the GustoNote apps and website (the "Service"). The provider is Robert Rosot, ul. Gen. St. Maczka 1/27, 34-400 Nowy Targ, VAT PL7351702205 (the "Provider"). Contact: info@gustonote.com.

2. Definitions

• Service - the GustoNote apps (tasting journal) and website.
• User - a person using the Service.
• Account - the User's individual profile.
• Free plan - the free scope of the Service.
• Pro plan - the paid, extended scope of the Service (purchased per module).
• Module - a tasting category (e.g. wine, whisky, beer, coffee, tea).

3. Scope of the Service

GustoNote is a tasting journal for recording notes, scores and sensory profiles, calibrating your description against a reference, and analysing your own entries. The Service also works offline (as a PWA), and data is synced with the User's account.

4. Technical requirements

To use the Service you need: a device with an up-to-date web browser, internet access (for sign-in and sync), and an active email address (or a Google account) to create an Account.

5. Account and registration

• An account is created by registering with an email and password, or by signing in with Google.
• Email registration requires confirming the address via a link sent to the provided email.
• The User must provide accurate data and keep their login credentials safe.
• The app concerning alcohol (wine, whisky, beer) is intended only for adults (18+). By creating an account and using this app, the User declares that they are at least 18 years old.

6. Free and Pro plans, payments

• The Free plan is free of charge and includes core features within a defined scope (e.g. a limited number of entries per module).
• The Pro plan removes limits and unlocks additional features in the purchased module. Pro is purchased separately per module.
• Current prices and the validity period of the Pro plan are shown on the website and in the app at the time of purchase.
• Payments are handled by an external provider, Przelewy24 (PayPro S.A.). The Provider does not store payment card data.
• The Pro plan is time-limited (e.g. an annual subscription) and - unless stated otherwise at purchase - does not renew automatically; upon expiry the module returns to the Free plan (the User's data is not deleted).

7. Featured (promotional content)

The Service may show the Provider's own and partner promotional content ("Featured") - in both the Free and Pro plans. Full-screen Featured items may appear only in the Free plan. The User can turn off Featured items in the app settings.

8. Right of withdrawal (consumers)

A consumer (and a sole trader treated as a consumer) may withdraw from the contract within 14 days without giving a reason. The Pro plan constitutes the supply of digital content/a digital service. If the User requests that performance (access to Pro features) begins before the withdrawal period ends and gives explicit consent, acknowledging the loss of the right of withdrawal upon full performance - the right of withdrawal expires once the service has been fully performed. For performance rendered up to the date of withdrawal, the consumer may be required to pay a proportionate amount.

9. Complaints

Complaints can be submitted to info@gustonote.com. We will handle complaints within 14 days and inform the User of the outcome by email.

10. User data and content

Entries, notes and other content created by the User remain their property. The User may export their data at any time (a copy in JSON format) and delete their account. Personal data processing is described in the Privacy Policy.

11. Liability

The Service is provided "as is". We make every effort to keep it working and available, but we do not guarantee uninterrupted, error-free operation. GustoNote is a tool for private notes - scores and calibration are auxiliary/educational. The Provider's liability is limited to the extent permitted by law; we do not exclude or limit liability where this is not permissible towards consumers. Third-party names and marks (including SCA - Specialty Coffee Association) belong to their owners and are used for descriptive purposes only; GustoNote is not affiliated with or certified by them.

12. Prohibited use

It is prohibited to use the Service unlawfully, in a way that infringes third-party rights, disrupts the Service, or attempts to gain unauthorised access to other Users' data.

13. Changes to the Terms

The Provider may change these Terms for valid reasons (e.g. legal or technical changes, change in the Service's scope). We will announce changes in the app or on the website. Continued use after the changes take effect constitutes acceptance; if the User does not accept, they may delete their account.

14. Termination

The User may stop using the Service at any time by deleting their account. The Provider may terminate the contract or block an account in case of a serious breach of these Terms or the law.

15. Governing law and disputes

Matters not regulated herein are governed by Polish law and applicable European Union law. This provision does not deprive a consumer of the protection afforded by the mandatory rules of their country of residence. Consumers may use out-of-court dispute resolution, including the European Commission's ODR platform.
